This Terms and Conditions form integral part of the
Order Form on the reverse side hereof.
By signing the Order Form the Customer and Top Shots
Glamour Photography Pty Ltd execute a legally enforceable agreement/contract
to perform their obligations as described hereto.
Top Shots Glamour Photography Pty Ltd shall provide the
Customer with the products and services as described on the Order Form within
reasonable time (hereafter referred to as the “Product”). Top Shots
Glamour Photography does not guarantee any time frame or specific date for
the delivery of the product, unless it is agreed upon and specified in writing
in the
Order Form. The Customer shall pay the total price agreed upon in the Order Form
(hereafter referred to as the “Price”) plus postage and handling costs.
Execution of this Order Form (and Terms and Conditions as
integral part of it) by the Customer constitutes complete approval by the
Customer of computer images of the Product as detailed in it.
The balance of the Price (“Balance Payable”) must be
paid in full by the Customer under this contract prior to the delivery of The
Product by Top Shots Glamour Photography Pty Ltd to the Customer,
regardless the method of payment chosen. The Customer is deemed to be the
party who is legally liable to pay the Price and the Customer acknowledges
such liability by executing this Order Form.
Payment of the Balance Payable can be made by cash,
credit card, Eftpos or Ezypay (Any change to the Ezypay authorisation form
must be agreed by the parties of this Order Form and the Customer agrees
that any inconvenient caused to Top Shots Glamour Photography Pty Ltd due
to the Ezypay agreement does not exonerate in any way the Customer from
full payment of the Balance Payable. Payment by Ezypay may not last longer
than 12 months and default of any instalment makes the amount of that
instalment immediately due) and the Balance Payable is due and must be
paid by the Customer within 7 days from completion by Top Shots Glamour
Photography Pty Ltd of its obligation to provide the Product, notified to
the Customer alternatively in writing, by telephone or e-mail.
Late payment of the Deposit Paid, Balance Payable or
any other agreed instalment will attract a 27.5% surcharge after 30 days
from the notification of outstanding balance, as a penalty due by the
Customer. The Customer will be liable for any legal or other cost incurred
by Top Shots Glamour Photography Pty Ltd in order to obtain any payments
due by the Customer under this Order Form.
The Customer agrees that this Order Form cannot be altered,
amended, varied or cancelled in any way by the Customer subsequent to its execution.
The Customer
agrees that personal collection of the Product at any of the Top Shots
Glamour Photography Pty Ltd’s studios constitutes complete acceptance of
the Product by the Customer. If the Product is in any way damaged when
delivered to the Customer by mail or courier, the Customer is deemed to
have accepted the Product unless he/she notifies Top Shots Glamour
Photography Pty Ltd of the damages within 8 days from the date of the
delivery.
The Customer acknowledges that he/she is eighteen (18)
years of age or older and has legal capacity to enter into this agreement/contract.
In the event that Top Shots Glamour Photography Pty Ltd is not satisfied
as to the Customer’s legal age, that company may request proof of the Customer’s
age by photographic identification.
The Customer shall be liable for the payment of all
postal or any other delivery charges incurred by Top Shots Glamour
Photography Pty Ltd to deliver the Product to the Customer.
Top Shots Glamour
Photography Pty Ltd may use the Product for promotional advertising or other
marketing purposes. The execution of this Order Form shall constitute express
written permission of the Customer for such use by Top Shots Glamour
Photography Pty Ltd. In the event that the customer does not agree to such
use, he/she will notify Top Shots Glamour Photography Pty Ltd in writing
upon execution of this Order Form by ticking this box:
